Affiliate & Partner Terms and Conditions

1. Agreement to Terms

By applying to become a Fingentify Partner or Affiliate ("Partner"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your participation in the Fingentify Associate/Partner Program ("Program").

2. Partner Requirements

To participate in the Program, you must:

  • Be at least 18 years of age
  • Have a valid business registration
  • Comply with all applicable laws and regulations
  • Submit all required verification documents
  • Maintain accurate and up-to-date information
  • Accept Associate partnership program agreement

3. Electronic Agreement Requirement

By participating in our Partner Program, you acknowledge and agree that:

Mandatory Electronic Agreement

  • All partners must electronically accept a separate Partner Agreement to complete their enrollment in the program
  • Your electronic acceptance constitutes a legally binding agreement between you and our company
  • The Partner Agreement supplements these Terms and Conditions and takes precedence in case of any conflicts

Acceptance Process

  • The electronic agreement will be presented during the partner onboarding process
  • You must review and accept the agreement before receiving your first commission payment
  • A secure, time-stamped record of your acceptance will be stored in our systems

Legal Effect

  • Your electronic signature has the same legal effect as a physical signature
  • By clicking "I Agree" or similar confirmation, you acknowledge your intent to be legally bound by the terms
  • A copy of your signed agreement is available in the partner area and can be downloaded at any time

Withdrawal Right

  • You have the right to withdraw your acceptance within 14 days of signing
  • Withdrawal requests must be submitted in writing to our support email
  • Any commissions earned before withdrawal will be paid according to the terms

4. Document Submission & Verification

As part of the application process, you must submit the following documents:

  • Government-issued photo ID (passport, driver's license, or national ID)
  • Proof of business registration
  • Proof of address (utility bill or bank statement not older than 3 months)
  • Tax identification number

Document Security: All documents are encrypted before upload and stored securely in our AWS S3 buckets with server-side encryption. We implement industry-standard security measures to protect your information.

5. Commission Structure

  • Partners will receive a commission for each successful sale (both first sales and recurring sales) referred by them, as outlined in the Program's Agreement.
  • The default commission structure is based on set tiers and will be applied initially, with a minimum commission payout per successful sale.
  • The commission rate may vary based on the Affiliate's performance, sales volume, or other factors as determined by the Program

6. Partner Obligations

As a Partner, you agree to:

  • Comply with all applicable laws and regulations
  • Not engage in any fraudulent or misleading marketing practices
  • Not use spam or unsolicited communications
  • Not bid on branded keywords without prior written approval
  • Maintain the confidentiality of your login credentials

7. Data Protection & Confidentiality

Both parties agree to:

  • Process personal data in compliance with GDPR and other applicable data protection laws
  • Implement appropriate technical and organizational security measures
  • Notify each other of any data breaches without undue delay
  • Not disclose confidential information to third parties without prior written consent

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fingentify SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of European Union and the laws of Ireland, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email 30 days before they take effect.
